ORDER

On October 08, 2007, thru the Office of the Mayor of Capas, filed an application for Environmental Compliance Certificate (ECC) for the proposed P1NATUBO ECO-TOURISM CAPAS GATEWAY PROJECT located in Brgy. Sta. Juliana. Capas, Tarlac.

On 19, October 2007, inspection was conducted by our field personnel at the proposed eco-tourism project site which showed that the project is operational consisting of Visitor's lounge, Korean Spa, Pinatubo trail, Trekking etc. Site development in the area was in progress without an approved ECC from this Office. This is clear violation of Section 41 of Presidential Decree (PD) 1586, otherwise known as the Philippine Environmental Impact Statement (EIS) System Law.

On 26, January 2008, the proponent was issued a Notice of Meeting (NOM) for a technical conference regarding on the area jurisdiction, EIS, and other agencies participation. However, the proponent or the representative failed to attend. Presumed negligence for failing to answer the queries, the application for ECC was dropped.

On 4 September 2009, a Notice of Violation (NOV) was issued to Mayor Reynaldo Catacutan of Capas for the above mentioned violation. A reply letter dated September 22, 2009 from the Office of the Mayor was received by this Office indicating among others that the Municipal Government of Capas did not undertake the rehabilitation instead the Pull Destination Corporation (PDC) is the proponent of the rehabilitation Project. A follow-up technical conference was held on October 15, 2009 with the stakeholders (PDC, Mayor Catacutan, and NCIP) and came up with an agreement fur the formulation of Memorandum of Agreement (MOA) for all stakeholders to be hosted by the Honorable Mayor of Capas.

As such, while we are waiting for the formulation of the Memorandum of Agreement (MOA) and in order to prevent any untoward incident and possible grave or irreparable damaged to the
environment considering the manifestations of climate change such as flashflood and heavy downpours occurred in the project site, you are hereby ordered to Cease and Desist (COD) from conducting further development in the area, until such time that Environmental Compliance Certificate (ECC) is secured from this Office. Likewise you are directed to pay the fine/penalty pursuant to Section 9 of PD 1586.
