Dear Ms. Contreras:

This refers to the application for endorsement Ortigas to the Philippine Economic Zone Authority (PEZA) of the proposed 75-room Green Canyon Eco-Tourism Park as locator at the Vicente, Bamban, Tarlac, Sub zone [Sacobia Area] within Clark Special Economic Zone.

In this connection and per this Office’s evaluation of the submitted documents, we have, thus, favorably endorsed the development project to the Philippine Economic Zone Authority for registration under Republic Act No. 7916, otherwise known as Special Economic Zone Act of 1995, as amended by RA 8748. A copy of the endorsement-letter of even date is hereto attached for your information.

You are likewise requested to comply with the following conditions:

1. The project shall conform with the existing safety, building and fire codes, ordinances, zoning and other pertinent regulations of the Clark Special Economic Zone as well as the laws, policies, rules, and regulations of other government agencies concerned to include the Comprehensive Agrarian Reform (CARL) of the Department of Agrarian Reform (DAR), Presidential Decree Nos. 1586 (The Philippine environmental Impact Statement System) and 1067 (The Water Code of the Philippines) and Proclamation No. 2146 2146 (Environmentally Critical Project and Areas) of the Department of Environment and Natural Resources (DENR);

2. The project shall adhere to the Department of Tourism’s standards for Class AAA Resort and Tourism ecozone/tourism estate in accordance with the DOT Accreditation Code and pertinent guidelines;

3. The construction and operation activities shall not adversely affect the ecological balance of the area;

4. The clearance/permit/license/ from concerned local and national government agencies shall be secured prior to construction and operation;

5. The project shall be in full commercial operation not later than February 2011; and

6. Prior to commercial operation, accreditation shall be secured from the Department of Tourism.

7. The required equity portion of the total project cost shall be put upon registration with the Philippine Economic Zone Authority.

Non-compliance with any of the above conditions shall render this endorsement ineffective.

Moreover, you are requested to update this Office on the status of the project by submitting to us the duly accomplished DOT Form No. OTS-002 (Pre-Opening Status Report) on a quarterly basis from the start of its construction until such time that it is put into commercial operation.

We trust that you will be guided accordingly.
