DOT MEMORANDUM CIRCULAR NO. 2006-02

ADOPTING THE IMPLEMENTING RULES AND REGULATIONS OF REPUBLIC ACT NO. 9257, OTHERWISE KNOWN AS THE EXPANDED SENIOR CITIZENS ACT OF 2003.

WHEREAS, President Gloria Macapagal Arroyo signed into law on February 26, 2004 Republic Act no. 9257, entitled An act Granting Additional Benefits and Privileges to Senior Citizens Amending for the Purpose Republic Act No. 7432, otherwise known as An act to Maximize The Contribution of Senior Citizens to Nation Building, Grant Benefits and Special Privileges and For Other Purposes.

WHEREAS, Rule V, Article 7, Section 4, of the Implementing Rules and Regulations of Republic Act No. 9257, provides the grant of twenty percent (20%) discount on all prices of goods and services offered to the general public regardless of the amount purchased from establishment, irrespective of classification, relative to the utilization of services for the exclusive use of senior citizen in the following: hotels and similar lodging establishments, restaurants and recreational centers;

WHEREAS, Rule V, Article 7, Section 5 of the IRR of RA No. 9257 provides a minimum of twenty percent (20%) discount on admission fees charged by theaters, cinema, houses and concert halls, circuses, carnivals and other similar places of culture, leisure and amusement for the exclusive use or enjoyment of senior citizens;

WHEREAS, Likewise, Rule V, Article 7, Section 10 of the Implementing rules and Regulations, provides at least twenty percent (20%) discount in fare for domestic air, and sea travel based on the actual fare, including the promotional fare, advance booking and similar discounted fare shall be granted for the exclusive use and enjoyment of senior citizens

WHEREAS, Rule V, Article 7, Section 11, of the said implementing rules and regulations also provides that twenty percent (20%) discount in public railways, including LRT, MRT, PNR, Skyways and fares in buses (PUB), jeepneys (PUJ), taxi and shuttle services (AUV) shall be granted for the exclusive use and enjoyment of senior citizens.

NOW, THEREFORE, for and in consideration of the above premises, all DOT accredited restaurants, hotels, tourist inns, apartels, pension houses, resorts and similar lodging establishments, sports and recreational clubs/centers, museums, galleries, tourist land, water and air transport operators, are hereby directed to grant twenty percent (20%) discount on prices of goods, admission fees and services to all senior citizens defined under rule III, Article 5.1 of RA9257, who shall avail of such goods and services and/or use the facilities of said establishments.

Failure to observe/comply with the grant of discount provided for herein shall render the concerned DOT accredited establishment and/or transport operator liable for administrative sanctions under the Dot rules and regulations on accreditation without prejudice to said establishment and/or transport operators liability of the penal provision provided for under R.A. No. 9257
